Terms of Service

1. Quotations and Acceptance

• All quotes are valid for 30 days unless stated otherwise. We may withdraw or revise a quote in the event of changes in materials cost or supply.
• Your acceptance (by written confirmation, email or purchase order) forms a binding agreement governed by these Terms.

2. Scope of Work

• We provide custom gate design, fabrication, installation and maintenance services, along with security bollard solutions.
• Unless expressly stated, work includes supply of materials and labour as defined in the quote. Any additional work or materials will require a revised quote.

3. Pricing and Payment

• Prices exclude GST unless clearly stated.
• A deposit of 50% of the quoted price is payable upon acceptance unless another arrangement is agreed in writing.
• The balance is due on completion of the work, payable within 7 days of invoice.
• Late payments accrue interest at 2% per month or the maximum rate permitted by law, whichever is lower.

4. Site Access and Services

• You must provide safe access to the site, including power, adequate lighting and clear workspace.
• Any additional costs resulting from unsafe or delayed access, or inadequate site services, will be passed on to you.

5. Installation Schedule

• We aim to install within the agreed timeframe. You agree to make the site available as per the schedule.
• Weather related delays are considered reasonable and we will notify you promptly if they occur.

6. Materials and Workmanship Warranty

• We warrant our workmanship for 12 months from completion date.
• Manufacturer warranties apply to supplied components where applicable.
• Warranty excludes damage from misuse, impact, weather beyond tolerances, vandalism or alteration by others.

7. Variations

• Any changes to the scope must be documented in a written variation order specifying cost and impact on timelines.
• Variations do not proceed until agreed in writing.

8. Risk and Title

• Risk passes to you upon installation and handover.
• Ownership (title) remains with NZ Gates until full payment has been received.

9. Limitation of Liability

• To the fullest extent permitted by law, our liability (including in contract, tort or otherwise) is capped at the total value of your contract.
• We are not liable for indirect, consequential or special losses including business interruption or loss of profit.

10. Cancellation

• You may cancel the work in writing prior to fabrication. We reserve the right to charge for work already completed and materials procured.
• If you delay the project by more than 30 days, we may charge additional holding costs or reschedule work.

11. Dispute Resolution

• In the event of a dispute you must notify us in writing. Parties will first seek to resolve the dispute through good faith negotiation.
• If unresolved, the dispute may be referred to mediation under the New Zealand Dispute Resolution Centre or another agreed mediator before exercising legal rights.

12. Governing Law

• These Terms are governed by the laws of New Zealand.
• Any dispute will be subject to the exclusive jurisdiction of the New Zealand courts.

13. Privacy

• We collect and hold personal information for the purpose of completing your order in compliance with the NZ Privacy Act 2020.

14. Acceptance

By accepting our quote or instructing us to proceed, you acknowledge that you have read these Terms, understand them and agree to be bound by them.
